1. Acceptance of Terms

By accessing or using MathPhi (the "Service"), provided by Brighter Lune LLC ("we," "us," or "our"), you ("User," "you," or "your") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the Service.

MathPhi is an educational platform providing IB Mathematics questions, test creation tools, and related services to educators and students. These Terms govern your use of our website, question bank, test builder, and all associated services.

2. Description of Service

MathPhi provides access to a comprehensive question bank for IB Mathematics (AI SL and AA SL courses), along with tools to create, customize, and generate tests. Our services include:

• Access to professionally authored mathematics questions
• Test building and customization tools
• PDF generation with LaTeX formatting
• Question filtering and search functionality

3. User Accounts and Eligibility

To access certain features of the Service, you must create an account. You must be at least 13 years old to use this Service. By creating an account, you represent that you are at least 13 years old and have the authority to enter into this agreement.

You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Intellectual Property Rights

4.1 MathPhi Content Ownership

All content provided by MathPhi remains our exclusive intellectual property. This includes but is not limited to:

• All mathematics questions in our question bank
• LaTeX source code, solutions, and marking schemes
• Question database structure and organization
• Diagrams, images, and supplementary materials
• Software, algorithms, and user interface

4.2 License to Use

Subject to your compliance with these Terms and payment of applicable fees, we grant you a limited, non-exclusive, non-transferable license to:

• Access questions in our database while your subscription is active
• Generate tests for your classroom or educational use
• Print and distribute generated tests to your students
• Use questions for legitimate educational purposes in your teaching environment

4.3 User-Generated Test Arrangements

While you may create specific arrangements or compilations of questions ("Test Arrangements"), you acknowledge that:

• You do not acquire ownership rights to the underlying questions
• Your Test Arrangements contain our copyrighted material
• Any Test Arrangement you create is subject to the usage restrictions in these Terms

4.4 Prohibited Uses

You may NOT:

• Extract, copy, or attempt to recreate our question database
• Share questions online, on social media, or in public forums
• Distribute questions to individuals who are not your students
• Create derivative question banks or competing services
• Sell, license, or commercially exploit questions or tests
• Claim ownership of any MathPhi content
• Remove or obscure copyright notices or watermarks
• Use automated tools to bulk download content

5. Subscription Terms and Payment

MathPhi offers both free and paid subscription tiers. Paid subscriptions provide enhanced access to our question bank and additional features.

Payments are processed through Stripe. By subscribing, you authorize us to charge your payment method for the selected subscription plan. Subscriptions automatically renew unless cancelled.

No Refunds: All payments are final and non-refundable. We do not provide refunds for any subscription fees, whether used or unused.

6. Usage Limitations and Fair Use Policy

Your use of the Service is subject to our Fair Use Policy, designed to ensure quality service for all users and protect against abuse.

6.1 Fair Use Guidelines

• Test generation is limited to reasonable educational and personal use
• Bulk downloading or systematic extraction of content is prohibited
• Automated access or scraping is strictly forbidden
• Account sharing is not permitted

6.2 Usage Limits

We implement reasonable usage limits that are generous for legitimate educational use. These may include:

• Daily and hourly PDF generation limits
• Maximum questions per test restrictions
• Concurrent request limitations
• Rate limiting on API endpoints

The specific limits may be adjusted at our discretion to maintain service quality and prevent abuse. Users engaged in normal educational use will rarely encounter these limits.

6.3 Prohibited Activities

The following activities are strictly prohibited and may result in immediate account termination:

• Attempts to systematically download or extract our entire question database
• Using automated tools, bots, or scripts to access the Service
• Circumventing or attempting to circumvent usage limits
• Sharing account credentials or allowing others to use your account
• Any activity that disrupts or degrades service performance for other users

6.4 Monitoring and Enforcement

We continuously monitor usage patterns for signs of abuse, including but not limited to:

• Unusual download patterns or volumes
• Systematic content extraction attempts
• Rapid sequential requests suggesting automation
• Multiple accounts from the same IP address

Violations of our Fair Use Policy may result in:

• Temporary access restrictions or throttling
• Reduced usage limits
• Account suspension or termination
• Legal action for severe violations

Note: We reserve the right to modify usage limits and fair use policies at any time to ensure optimal service for all users.

7. IB Organization Disclaimer

MathPhi is not affiliated with, endorsed by, or connected to the International Baccalaureate Organization. Our questions are designed for IB Mathematics practice but are independently created. IB® is a registered trademark of the International Baccalaureate Organization.

8. Privacy and Data Collection

Our privacy practices are described in our separate Privacy Policy. By using the Service, you acknowledge that we collect and process information as described in our Privacy Policy.

9. Enforcement and Violations

Unauthorized copying, distribution, or commercial use of our question bank may result in substantial damages and legal action. We take intellectual property violations seriously.

We reserve the right to:

• Monitor usage patterns and investigate violations
• Suspend or terminate accounts for Terms violations
• Pursue legal action for intellectual property infringement
• Issue takedown notices for unauthorized use of our content

10. Termination

Either party may terminate this agreement at any time. We may suspend or terminate your account immediately for violations of these Terms, non-payment, or other reasons deemed necessary to protect our service or other users.

Upon termination:

• Your access to the Service will cease immediately
• No refunds will be provided for unused subscription time
• You must stop using any downloaded materials
• All license rights granted to you will terminate

11. Disclaimers and Limitation of Liability

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not guarantee that our questions will match actual IB exam content or difficulty levels.

Limitation of Liability: To the maximum extent permitted by law, Brighter Lune LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service, even if we have been advised of the possibility of such damages.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Wyoming, United States, without regard to conflict of law principles. Any disputes arising from these Terms or your use of the Service shall be resolved exclusively in the courts of Wyoming.

13. Changes to Terms

We reserve the right to modify these Terms at any time. Changes become effective immediately upon posting to the website. Your continued use of the Service after any changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.
